These terms and conditions (“Terms”) govern your use of the Trackside Seats website and your purchase of tickets and related products through it. [COMPANY LEGAL NAME], trading as Trackside Seats (“we”, “us”, “our”), is the seller. By placing an order you agree to these Terms, so please read them carefully. Nothing in these Terms affects your legal rights as a consumer.
1. About us and how to contact us
Trackside Seats (“we”, “us”, “our”) is a business based in the United Kingdom. You can contact us at help@tracksideseats.com, or by post at [BUSINESS ADDRESS].
2. About our service
We are a motorsport ticket marketplace. We source tickets, grandstand seats and hospitality for Formula 1, MotoGP and related events from trusted supply partners and sell them to you through a single storefront. When you buy from us, your contract for the ticket is with us as the seller; our supply partners fulfil the tickets on our behalf. The price you pay is the price shown to you at checkout.
3. Eligibility
To place an order you must be at least 18 years old, be able to enter into a legally binding contract, and provide accurate and complete information. You are responsible for keeping your account details secure.
4. Orders and how a contract is formed
When you place an order you are making an offer to buy. During checkout we place a temporary reservation for your tickets with our supply partner, which is held for a limited time shown on screen, so please complete payment before it expires. A binding contract is formed only when we have received payment and sent you an order confirmation.
We may decline or cancel an order, for example if the tickets are no longer available, if there has been a pricing or description error, or if we suspect fraud or a breach of these Terms. If we cancel an order you have paid for in these circumstances, we will refund you in full.
5. Prices, fees and payment
All prices are shown in the currency displayed on the website and include any applicable taxes. Our prices may include a margin over the price we pay our supply partners, and any booking or service fee. The full price you will pay, including any fees, is shown before you confirm your order, and we will not add charges you have not agreed to.
Payment is taken at the point your order is confirmed, through our payment providers Stripe or Airwallex. If a price is obviously wrong due to an error, we are not obliged to honour it; we will tell you and give you the choice to reconfirm at the correct price or cancel for a full refund.
6. Ticket information and delivery
Before you buy, we show you the key details of your tickets, including the event, the seating area or category, and any restrictions we are aware of. Tickets may be delivered as e-tickets, mobile tickets or physical tickets, depending on the event and supplier. Some tickets, particularly hospitality and allocated-seating tickets, are issued close to the event date. We will let you know the expected delivery method and timing for your order.
7. Your right to cancel
Tickets for events on a specific date are treated in law as services related to leisure activities provided for a specific date. Under regulation 28(1)(h) of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, these are exempt from the standard 14-day cancellation (“cooling-off”) right that applies to most online purchases.
This means that once your order is confirmed it is non-cancellable and non-refundable, except where an event is changed or cancelled (see below), where we agree otherwise, or where you have other rights under law. Please check your order carefully before you pay.
8. Event changes, postponement and cancellation
Events are organised by third parties, and dates, schedules and line-ups can change for reasons outside our control. If an event is cancelled and not rescheduled, we will offer you a refund of the ticket price in line with the relevant organiser and supplier terms. If an event is postponed or rescheduled, your tickets will normally remain valid for the new date; whether a refund is available in that case depends on the organiser’s terms.
Refunds are made using your original payment method. Booking or service fees may be non-refundable except where the law requires otherwise. We will always pass on refunds we receive from organisers or suppliers for a cancelled event, but we cannot control organiser decisions or timescales.
9. Changes to your order
Changes to an order after it is confirmed, such as changing an attendee name, are subject to the rules of the event organiser and our supply partner and may not be possible. Please contact us as early as possible if you need to request a change.
10. Use and resale of tickets
Tickets are supplied for personal use and are subject to the terms and conditions of the event organiser and venue. Unauthorised resale, or use of a ticket for advertising, promotion or other commercial purposes, may breach those terms and can result in the ticket being cancelled or entry being refused. You are responsible for complying with the organiser’s and venue’s rules while attending an event.
11. Our responsibilities and liability to you
We will provide our services to you with reasonable care and skill, as required by the Consumer Rights Act 2015. We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these Terms or failing to use reasonable care and skill, but we are not responsible for loss or damage that is not foreseeable.
We do not exclude or limit our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and for any other liability that cannot be excluded or limited under English law.
We are not responsible for the running of an event, or for the acts or omissions of event organisers, venues or other third parties. Subject to the paragraph above, our total liability to you for any order is limited to the total price you paid for that order, and we are not liable for indirect or consequential loss.
12. Events outside our control
We are not liable for any failure or delay in performing our obligations where that failure or delay results from events outside our reasonable control, such as extreme weather, strikes, failures of public or private telecommunications networks, or the cancellation or rescheduling of an event by its organiser.
13. Accuracy of information
We take care to make sure the information on our website is accurate and up to date, but we cannot guarantee that it is always free from errors. Event details, dates and availability are subject to change by organisers and suppliers.
14. Complaints
If something has gone wrong with your order, please contact us at help@tracksideseats.com and we will do our best to put it right. We aim to acknowledge complaints promptly and resolve them fairly.
15. Governing law and jurisdiction
These Terms and any dispute arising from them are governed by the law of England and Wales, and the courts of England and Wales will have jurisdiction. If you live elsewhere in the UK, you may also bring proceedings in your local courts, and you keep the benefit of any mandatory consumer protections that apply where you live.
16. Changes to these terms
The Terms that apply to your order are those in force at the time you place it. We may update these Terms for future orders, and the current version will always be available on this page with the “last updated” date shown at the top.
17. General
If any part of these Terms is found to be unenforceable, the rest will remain in force. If we do not enforce a right under these Terms, that is not a waiver of that right. We may transfer our rights and obligations under these Terms to another organisation, and we will tell you if we do; this will not affect your rights.
